Privacy Policy
LAYERED ("we", "our", or "us") operates the LAYERED mobile application and the websites at layeredar.com, store.layeredar.com, and creators.layeredar.com. This policy explains what data we collect, why we collect it, and how you can control it.
1. Data We Collect
1.1 Location Data
LAYERED is built around GPS-anchored AR objects. We ask for your device's location only when you need it: when you anchor an object, to pin it to the spot you chose, and when you look for objects placed near you. The app explains why before your phone asks for permission, and turns location off again when it's no longer in use. We do not sell your location data to third parties. Location data is associated with your account and stored in our database to make the AR experience work across sessions and devices.
1.2 Account Information
When you create an account, we collect your email address and the display name you choose. If you sign in with Google or another OAuth provider, we receive only the basic profile information that provider makes available (email, display name, profile photo). We do not receive your passwords from OAuth providers.
1.3 User-Generated Content
Objects you place in the world — 3D models, text, position data — are stored on our servers and are visible to other users of LAYERED who are physically near those locations. Do not place objects containing sensitive personal information.
1.4 Usage Data
We collect anonymous analytics about how the app is used: screens viewed, features tapped, session length, crash reports. This data is collected via Firebase Analytics and helps us improve the app. It is not linked to your identity in a way that would be shared externally.
The LAYERED app is built with Unity. Unity collects technical and operational data about how the app runs on your device — device model, operating system, performance and crash information — and may process it in accordance with the Unity Privacy Policy. This processing happens as part of the normal operation of the game engine the app is built on.
1.5 Payment Data
All payment processing is handled by Stripe. We do not store your credit card numbers or banking details on our servers. We receive from Stripe only what is needed to manage your subscription or purchase history (transaction ID, amount, date, last 4 digits of card).
1.6 Your Inventory
Items you purchase are stored in a private inventory associated with your account, hosted on Cloudflare R2. We maintain an ownership record for each item — what you own, when you acquired it, and its transfer history — so that ownership can be verified and transfers between users can be processed. Your inventory is private and is not visible to other users unless you choose to list an item for sale.
You may export your entire inventory at any time from your account settings. See our Terms of Service for the full terms governing what you own.
2. How We Use Your Data
- To provide the core AR experience (showing you nearby objects, letting you place your own)
- To associate placed objects with your account and display your creator name
- To process payments and pay out creator earnings
- To send you transactional emails (purchase confirmations, payout notifications)
- To enforce our Terms of Service and detect abuse
- To improve the product through aggregated, anonymized analytics
3. Data Sharing
We do not sell your personal data. We share data only with the following service providers, under contractual obligations to protect it:
- Firebase (Google): Authentication, database, storage, analytics
- Unity: The game engine the app is built on — device, performance and crash data (Unity Privacy Policy)
- Stripe: Payment processing and creator payouts
- Cloudflare: DNS, CDN, object storage, email routing
- Google Play: App distribution and in-app billing (where applicable)
4. Your Rights
You may request access to, correction of, or deletion of your personal data at any time by contacting us at the address below. To delete your data from the app, open the options menu (the "⋯" button) and tap Delete my data; this removes everything LAYERED stored on your phone immediately. To delete data held on our servers — including your account and any waitlist sign-up — email us from any device at the address below. We will process deletion requests within 30 days.
If you are in the European Union or United Kingdom, you have rights under GDPR including the right to data portability and the right to lodge a complaint with your local supervisory authority.
5. Data Retention
Account data is retained while your account is active. After account deletion, we remove your personal data within 30 days, except where retention is required by law (e.g., financial records required for tax purposes, retained for 7 years). Anonymized analytics data may be retained indefinitely.
6. Children
LAYERED is not directed to children under 13. We do not knowingly collect personal data from children under 13. If you believe a child under 13 has created an account, contact us and we will delete it promptly.
7. Changes to This Policy
We may update this policy as the product evolves. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect.
Terms of Service
By downloading the LAYERED app or accessing our websites, you agree to these Terms of Service. If you do not agree, do not use LAYERED.
1. The Service
LAYERED is an augmented reality platform that lets users place 3D objects at GPS coordinates in the real world, visible to other users of the app who are physically nearby. We also operate a creator marketplace where users can purchase and download AR objects made by third-party creators.
2. Your Account
You must be at least 13 years old to create an account. You are responsible for maintaining the security of your account credentials. You may not share your account with others. LAYERED is not liable for losses resulting from unauthorized access to your account.
3. Content You Place
You are solely responsible for every object you place in the real world through LAYERED. By placing content, you represent that you have the right to place it and that it does not violate any law or these terms.
3.1 Prohibited Content
You may not place objects that:
- Are sexually explicit or contain nudity
- Depict graphic violence or promote harm to any person
- Constitute harassment or are designed to target a specific individual
- Infringe any third party's intellectual property rights
- Contain malicious code or are designed to damage devices
- Violate any applicable law or regulation
- Are placed on or inside private property without the property owner's permission
- Impersonate another person or organization
4. What You Own
When you purchase an item on LAYERED, we grant you a perpetual, non-revocable, transferable license to use, display, gift, or sell that item within the LAYERED ecosystem. You may not copy, duplicate, reverse-engineer, or redistribute the item outside the platform.
4.1 One Purchase, One Instance
Each purchase gives you one instance of the item. An instance exists either in your inventory or placed in the world — never in both places at once, and it cannot be duplicated. You may recall a placed item back to your inventory at any time, from anywhere. If you want the same item in more than one location simultaneously, you must purchase additional instances.
Creators may set a maximum number of instances any one account can purchase, and may publish limited editions with a fixed total supply.
4.2 Gifting and Resale
You may gift or sell any instance you own to another LAYERED user. You set your own resale price. When an instance is resold, proceeds are distributed as follows:
- 85% to you, the seller
- 10% to the item's original creator, as a standing royalty
- 5% to LAYERED
Proceeds from resale are credited to your account as LAYERED Credits, which may be spent anywhere on the platform. Credits are not redeemable for cash and have no value outside LAYERED. Only verified creators who have completed identity verification through Stripe may withdraw earnings to a bank account.
4.3 Your Right to Export
You may export your entire library at any time, in open formats, from your account settings. This right is not a courtesy and will not be withdrawn. It exists so that what you paid for remains in your possession regardless of what happens to LAYERED.
4.4 When We May Disable an Item
We may disable an item only where required by law, court order, or a valid DMCA claim, or where the item is found to be unlawful. In such cases we will notify you of what happened and why. Where the cause is not your own conduct, you will be refunded the purchase price. We will not disable items silently, and we will not do so for commercial convenience.
4.5 Payments and Refunds
Purchases are processed by Stripe. Sales are final unless the item materially differs from its description, in which case contact us within 7 days for a refund. Refunded items are removed from your inventory.
5. LAYERED's Rights
We reserve the right to remove any content placed through LAYERED, suspend or terminate any account, and modify or discontinue any feature, at any time and for any reason, with or without notice. We will make reasonable efforts to notify you before terminating your account, except when immediate action is required (e.g., illegal content). Termination of an account does not extinguish the rights described in Section 4 with respect to items lawfully purchased.
6. Intellectual Property
LAYERED, its logo, and the technology underlying the app are owned by LAYERED and protected by intellectual property laws. Content you create and place remains yours, subject to the license you grant us in these terms. By placing content in LAYERED, you grant us a non-exclusive, worldwide, royalty-free license to display that content to other users of the app as part of the normal operation of the service.
7. Disclaimer of Warranties
LAYERED is provided "as is" without warranties of any kind. We do not warrant that the service will be uninterrupted, error-free, or that content placed by users will always be visible or accurately positioned. GPS accuracy varies by device and environment.
8. Limitation of Liability
To the maximum extent permitted by law, LAYERED is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months before the claim arose.
9. Governing Law
These terms are governed by the laws of the jurisdiction in which LAYERED operates, without regard to conflict of law principles. Disputes will be resolved by binding arbitration, except that either party may seek injunctive relief in court for intellectual property violations.
10. Changes
We may update these terms. Continued use of LAYERED after changes take effect constitutes acceptance of the updated terms. We will give at least 14 days' notice of material changes.

Creator Agreement
This Creator Agreement ("Agreement") governs your participation as a creator on the LAYERED platform. By uploading any object to the LAYERED marketplace, you agree to this Agreement in addition to our Terms of Service.
1. Who Can Be a Creator
Any registered LAYERED user may apply to become a creator. Creators must be at least 18 years old (or the age of majority in their jurisdiction) to receive payments. You must provide accurate information when connecting your Stripe account for payouts.
2. Your Content
You retain full ownership of the 3D objects and other content you upload to LAYERED. By uploading an object to the marketplace, you grant LAYERED a non-exclusive, worldwide, sublicensable, royalty-free license to:
- Display your object in the LAYERED app to all users
- Use thumbnails and previews of your object in marketing materials
- Distribute your object to users who purchase or download it
- Transcode or reformat your object for compatibility with the platform
This license continues for as long as your object is listed on the marketplace. If you remove an object, users who previously purchased it retain access to their purchased copy, but new purchases stop immediately.
3. Content Standards
You are responsible for ensuring your uploaded objects meet our standards. Objects must:
- Be your original work or content you have the right to distribute
- Not infringe any third party's copyright, trademark, or other intellectual property
- Not contain malicious code, trackers, or hidden functionality
- Not be sexually explicit, violent, or otherwise prohibited by our Terms of Service
- Accurately match their title, description, and category
- Meet our technical requirements (GLB format, max 50MB, max 200K triangles, max 2048×2048 textures)
4. Review Process
Verified creators have their objects auto-approved and go live immediately after upload. Verified status is earned by maintaining a quality score above 8.0/10 with no policy violations in the past 90 days.
New creators have a manual review period of 24–48 hours for each upload. Our team reviews for technical quality, content policy compliance, and accurate metadata. You will receive an email when your object is approved or rejected, with a reason for rejection.
LAYERED may remove any object at any time, with or without notice, if it is found to violate this Agreement or our Terms of Service.
5. Pricing and Revenue Share
You set the price of your objects. Free objects may also be offered. For paid objects sold on the primary market:
- Creator receives: 70% of each sale's net amount (after Stripe processing fees)
- LAYERED receives: 30% as a platform fee
Example: A $2.99 object sold in the US. Stripe fee is ~$0.39. Net to split is $2.60. Creator receives $1.82; LAYERED receives $0.78.
5.1 Standing Royalty on Resale
Buyers on LAYERED own the instances they purchase and may resell them to other users. Every time one of your objects is resold — the first time and every time after — you receive a 10% royalty on the sale price. This royalty is automatic, applies for the life of the object, and requires no action on your part.
5.2 Instances and Supply
Each purchase entitles a buyer to one instance of your object, which exists either in their inventory or placed in the world, never both. Buyers who want your object in several locations must purchase several instances. You may configure:
- Purchase cap: the maximum instances one account may buy. Default is 25; you may set any value from 1 upward.
- Open edition: unlimited instances available. This is the default.
- Limited edition: a fixed total supply that will never be increased. Once sold out, the object is only obtainable on the resale market — where your 10% royalty continues to apply.
A limited edition's supply is final. Neither you nor LAYERED may increase it after publication. This guarantee is what gives the edition its meaning, and we will not make exceptions to it.
5.3 Withdrawing an Object
You may remove an object from sale at any time. Doing so stops new purchases immediately. It does not affect instances already sold: buyers keep what they bought, may continue to resell it, and your royalty continues to apply to those resales.
6. Payouts
Payouts are processed via Stripe Connect. You must connect a valid bank account through Stripe to receive earnings. Earnings become available for withdrawal 7 days after the sale date (to allow for refund windows). There is no minimum payout threshold — you may withdraw any available balance at any time. Withdrawals are typically deposited within 2–5 business days depending on your bank.
LAYERED is not responsible for delays caused by Stripe or your financial institution. You are responsible for any taxes owed on your creator earnings. LAYERED will provide a Stripe-generated annual earnings summary if requested.
7. Creator Pro Subscription
The Creator Pro subscription ($9.99/month) grants featured placement in search results and category pages, priority review, and access to advanced analytics. The subscription fee is separate from the 70/30 revenue split, which applies regardless of subscription status. Creator Pro does not change the revenue share.
8. Termination
Either party may terminate this Agreement at any time. If you close your creator account, pending earnings above $1.00 will be paid out within 30 days. If LAYERED terminates your account for policy violations, pending earnings may be forfeited if the violation caused financial harm to users or LAYERED.
DMCA Policy
LAYERED respects intellectual property rights and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we will respond expeditiously to valid notices of alleged copyright infringement.
1. Reporting Copyright Infringement
If you believe that content available through LAYERED infringes your copyright, please send a written notice to our designated agent containing all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works on one site are covered by a single notification, a representative list)
- Identification of the infringing material and information sufficient for us to locate it (e.g., the object name and approximate GPS location, or a link to where it appears)
- Your contact information: name, address, telephone number, and email address
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
2. Where to Send Notices
Send DMCA takedown notices to:
3. What Happens After We Receive a Notice
Upon receipt of a valid notice, we will:
- Remove or disable access to the allegedly infringing content promptly
- Notify the user who placed or uploaded the content that it has been removed
- Provide that user with a copy of the notice (with your contact information redacted if you request it)
4. Counter-Notification
If your content was removed and you believe it was removed in error — for example because you have a license to use the work, or your use constitutes fair use — you may submit a counter-notification to our DMCA agent. The counter-notification must include:
- Your physical or electronic signature
- Identification of the removed content and its former location in LAYERED
- A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification
- Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district
If we receive a valid counter-notification, we may restore the content within 10–14 business days unless the complainant files a court action within that period.
5. Repeat Infringers
LAYERED will terminate the accounts of users who are determined to be repeat infringers. A user who receives three or more valid DMCA notices in any 12-month period may have their account permanently suspended.
6. Other Intellectual Property
This policy addresses copyright infringement under the DMCA. For trademark infringement, right of publicity claims, or other intellectual property concerns, please contact us at the address above and describe your concern in detail. We handle non-copyright IP concerns on a case-by-case basis.
